Happy Birthday To You’ isn’t free to sing, at least if you’re singing at part of a profit making venture, such as when a restaurant brings out a birthday cake to a smiling ten-year-old. Restaurants aren’t allowed to sing ‘Happy Birthday’ to their guests. At least without express written consent from Warner Music…

 

That’s right. Warner own the copywriting to ‘Happy Birthday To You.’ In fact, the song is estimated to be the highest-earning song EVER, with earnings of over $50 million. Not bad for a little birthday rhyme.

 

However, while it’s true Warner did own the copyright to ‘Happy Birthday To You,’ that’s no longer the case. Common sense has prevailed.

 

Let’s give a big hip-hip hooray for common sense!

 

In 2015, a U.S. federal judge finally ruled that Warner’s copyright was invalid. The court declared ‘Happy Birthday To You’ as part of the public domain, leaving restaurants free to sing ‘Happy Birthday’ whenever they bring out a birthday cake. And we think that court ruling was a happy birthday present to people everywhere.

 

After that roller-coaster of emotions, here’s something special; the most famous rendition of ‘Happy Birthday To You’ ever. That’s right. It’s Marilyn Monroe singing “Happy Birthday Mr President” to the U.S. President, John F. Kennedy.
